Bill No. 220110 would add additional requirements for demolition permits for structures that were ever used as religious facilities and that were built 50 or more years ago. This bill is problematic for several reasons. Apart from the practical considerations, the bill is not legally effective or enforceable, according to the Philadelphia Law Department. The passage of this bill did not follow the legal process prescribed by State law. Additionally, enforcing the bill would require the Department of License and Inspection (L&I) to exceed is legal authority in order to consider community opposition when processing permit applications. Bill No. 220413 amends Section 19-1303 of The Philadelphia Code, entitled "Discounts and Additions to Tax," by tolling additions, interest and penalties on real estate tax when the assessed value of property is under appeal and limiting tax payments due based on certain assessments under appeal. While supportive of the intent of this legislation, my Administration has concerns that this bill is bad fiscal policy. This Bill incentivizes anyone who sees an increase from 2022 to 2023 to appeal to delay an increased tax bill, even if their underlying assessment value is accurate. Additionally, delaying receipt of certain Real Estate Tax revenue until the Board of Revision of Taxes appeals come through can have negative budget implications, depending on when appeals get decided, when revised tax bills are issued, and when revenue is received. There are many incredible, professional, and well run RCOs throughout the City of Philadelphia, but there are a number of RCOs that are not. We believe that only through extensive reforms and professionalization can we ensure that every neighborhood, regardless of economic stability, has a well-functioning RCO.
